Restraining Orders:
Divorce can be messy and almost always brings up heated emotions and strong feelings. Regretably, due to frustrations and other emotions, people can rely on violence to release their feelings. If you fear for your safety or for your childrens' safety, you can request a restraining order. A temporary restraining order is first, followed by a hearing at which the parties involved will argue for and against a permanent restraining order.
Community Property:
California is a community property state. What this means is tha, as a general rule, all property acquired during the marriage is presumed to be community property. Both the husband and the wife each have a 1/2 interest in such property. There may be facts that can rebut this presumption. Please call to discuss the particulars with an attorney.
Child Custody, Visitation, and Support:
If there are minor children involved in your divorce, these issues will need to be decided upon. There is legal custody and physical custody. Child support will probably also need to be determined. |
